    Family Law Case Study

    When our client came to us, she had been living with the consequences of a divorce settlement that had left her with virtually nothing.

    During her divorce, she had been pressured into signing a consent order by her former husband. She had been having an affair and was deeply worried that, if the details became known within her close-knit community, it would have devastating personal consequences. Her husband used that fear as leverage, convincing her to give up her share of a matrimonial estate worth around £750,000.

    Before the court approved the consent order, the court wrote to her and made enquiries whether she had entered into the agreement freely. Still terrified of the repercussions, she said she had not been pressured.

    Years later, the very thing she had feared happened. Her former husband began speaking openly about the affair, damaging her reputation within the community. By then, she had little income and had walked away from assets that should have provided her with long-term financial security.

    She believed nothing could be done.  We saw things differently.

    Reopening a final financial settlement is exceptionally difficult. The courts place great importance on finality, and applications to set aside consent orders face a high legal threshold.

    We carefully built her case, demonstrating the circumstances in which the original agreement had been reached and why justice required the court to look at it again.

    The result? After just one hearing, we secured a significantly improved financial settlement for our client, giving her the financial security she should have received in the first place.

    This case is a reminder that, while final orders are intended to bring matters to a close, there are exceptional circumstances where the court can intervene.
